LAW4007 นิติปรัชญา (Philosophy of Law)
ศึกษาเชิงวิเคราะห์ถึงแนวความคิดด้านปรัชญากฎหมายของสํานักความคิดต่างๆ ที่สําคัญในอดีตและปัจจุบัน ตลอดจนปัญหารากฐานสําคัญในเชิงทฤษฎีกฎหมาย อันรวมถึงเรื่องความสัมพันธ์ หรือความขัดแย้งระหว่างกฎหมายกับศีลธรรม หลักศักดิ์ศรีความเป็นมนุษย์อันเท่าเทียมกันหรือสิทธิมนุษยชน หลักนิติธรรมและความยุติธรรม ธรรมชาติแห่งความสัมพันธ์ระหว่างกฎหมายกับอํานาจรัฐ หรือการเมือง บทบาทของกฎหมายในการสร้างความเป็นธรรมของสังคม ข้อถกเถียงเรื่องความยุติธรรมบนพื้นฐานของหลักเรื่องความเสมอภาค และหลักอรรถประโยชน์ การปฏิวัติรัฐประหารและปัญหาความชอบธรรมเชิงนิติปรัชญาในการใช้อํานาจรัฐ พันธะหน้าที่ในการเคารพเชื่อฟังกฎหมาย และปัญหาเรื่องการปฏิเสธหรือดื้อแพ่งต่อกฎหมายที่ไม่เป็นธรรมโดยสันติวิธี
The analytical study of conceptions in legal philosophies attached to various major schools of thought in the past to the current time. The course will cover some significantly foundational problems in legal theory, including the relation or contradiction between law and morality, the equality principle of human dignity or human rights, the rule of law and justice. Particular issues to be considered also include : the related nature of law and state authority-politics, the function of law in contribution to social justice, conceptual arguments on the principle of justice based on equality and utility, revolution-coup d’etat and the consequential problem of legal philosophy on its assumption of state authority, the obligation to obey the law and the question of civil disobedience.
